Court postpones hearing on no-match rule
On Nov. 12, U.S. District Court Judge Charles R. Breyer granted a motion to postpone a hearing on the U.S. Department of Homeland Security's final no-match rule.
The motion was brought by a group of business organizations, including NRCA, and labor organizations, which had filed a lawsuit against the original rule and wanted the court to postpone a hearing on the case, which had been scheduled for Dec. 12.
Attorneys involved in the case will meet with Breyer Dec. 5 to present arguments regarding when the hearing should be rescheduled. Given the complexity of the case, it is possible the hearing will not be rescheduled until Januarypossibly after president-elect Barack Obama's Jan. 20 inauguration. Sources within the Obama transition team have indicated tentatively that Obama does not support the no-match rule, and extended litigation in this case would make it easier for the incoming Obama administration to rescind the rule if officials choose to pursue that course.
