Contractor faces $278,452 in proposed penalties

Twice within one month, the Occupational Safety and Health Administration found Miller Building Systems LLC, Arcola, Ill., exposing employees to falls as they performed residential framing work on houses in Savoy, Ill., according to OSHA. The company is not an NRCA member.

On June 26, 2023, and July 26, 2023, OSHA inspectors observed Elmer Miller’s employees, operating as Miller Building Systems LLC, standing, climbing and walking on the roofs, beams and top plates of the houses without any fall protection—sometimes at heights more than 18 feet above the ground.

OSHA cited three willful and four serious violations and proposed $278,452 in penalties. The company was cited for lack of fall protection and not providing a means of egress from the roof.

OSHA currently has five other inspections with Elmer Miller that were opened in August 2023, October 2023 and November 2023. During the past decade, OSHA has cited Miller and companies he operates 20 times—including repeat violations and willful violations—and assessed more than $900,000 in penalties, most of which has not been paid. Most of the violations relate to not protecting workers from potentially deadly fall hazards while building roofs.
