NRCA urges all members to reach out to their members of Congress to advocate for legislation to support commonsense liability safeguards for employers that must navigate a new and rapidly changing workplace environment.
As roofing industry companies continue to provide essential services during the COVID-19 pandemic, it is important they have reasonable legal certainty in which to conduct operations. Companies are striving to do the right thing, including implementing safety protocols to protect employees and the public in response to updated guidance from the Centers for Disease Control and Prevention, Occupational Safety and Health Administration and state authorities. However, given the high degree of uncertainty in the new environment, there is a substantial risk of companies becoming the targets of COVID-19-related lawsuits that ultimately will do nothing to reduce the threat of the virus.
By providing limited and rational safe harbors for good actors, Congress can help ensure the critical needs of Americans are met during this time. Liability protections should be appropriately tailored and limited to the present emergency and a reasonable period of recovery.
