Contractor faces $180,469 in proposed fines for exposing workers to fall hazards

On May 25, Occupational Safety and Health Administration inspectors observed employees of Overhead Solutions LLC, Suamico, Wis., working about 30 feet above the ground on a Menasha, Wis., apartment complex roof without adequate fall protection, according to OSHA. Thirteen days later, an inspector observed subcontractors on a 10-foot-high roof in Appleton, Wis., without fall protection. The company is not an NRCA member.

At the Menasha job site, after an Overhead Solutions manager attended an on-site training discussion about fall hazards, inspectors found employees wearing fall-protection harnesses and anchors installed on the building’s roof with ropes attached to the anchors, but readily accessible lifelines were not attached as required. Inspectors also observed employees exposed to deadly fall hazards as they unloaded a pallet raised to the roof by a mechanical lift.

At the Appleton job site, an inspector observed an Overhead Solutions project manager handing out energy drinks to subcontractors on a 10-foot-high roof; the workers lacked fall protection and the manager did not correct the hazard. OSHA inspectors also learned the company had no documented accident prevention plan.

Overhead Solutions received citations for four repeat violations and one serious violation of federal fall-protection standards. The repeat violations are similar to those for which OSHA cited the company in Neenah, Wis.; Seymour, Wis.; and Wrightstown, Wis., in 2022.

OSHA has assessed the company with $180,469 in proposed penalties.
