The Equal Employment Opportunity Commission has issued guidance for employers regarding the COVID-19 vaccine, according to www.natlawreview.com.
The guidance states employers may require employees to take the COVID-19 vaccine, subject to certain legally protected exceptions for disability and sincerely held religious beliefs. Additionally, if an employer requires the vaccine, or contracts with a vendor to provide the vaccine, the pre-vaccination medical screening questions are subject to Americans with Disabilities Act standards for disability-related inquiries that are job-related and consistent with business necessity. In addition, the Centers for Disease Control and Prevention’s advisory group, the Advisory Committee on Immunization Practices, is recommending adults over 75 and front-line essential workers—including teachers and employees in grocery stores, meat plants, prisons and public transit—be given priority as the next recipients of the COVID-19 vaccine.
