Update regarding Executive Order ensuring adequate COVID-19 safety protocols for federal contractors

The Employment Policy Division of the U.S. Chamber of Commerce recently shared an update regarding the Executive Order that requires federal contractors to ensure their covered employees are fully vaccinated against COVID-19.

Biden administration procurement officials have released a memo detailing how federal agencies should include contract language in their “deviations”—changes from current contracts—to implement the requirements of the Executive Order and the accompanying guidance issued Sept. 24. The contract language says contractors should comply with all guidance issued by the Safer Federal Workforce Task Force related to the Executive Order and must include this language in subcontracts of all tiers.

The memo also reiterates agencies are “strongly encouraged” to apply the requirements of the guidance in contracts not covered by the Executive Order, such as contracts below the simplified acquisition threshold.
